Construct and install an illuminated business identification signage within Commercial 1 Zone and Heritage Overlay

It is my view that due to a desire to rebrand the illuminated signs, that the "right of use" provisions noted in the VCAT decision of Kevak Hotels Pty Ltd v Darebin CC [2022] VCAT 318 apply only to premises use that is the same or substantially similar, and not to the display of signs that are illuminated at night as they are matters ancillary to the premises use.

The display of signage illuminated at night is a matter that needs to be carefully considered regarding its necessity, response to context, heritage overlay, the Decision Guidelines, and the Clause 65 VPP matters.

I consider that the matters regarding needing a permit, and impacts upon amenity apply whether the signage is erected on a street or boundary wall, roof, inside a glazed area and that the defining element of it impacting upon community amenity and character is that if it is visible from the public realm, a road, and/or any surrounding site.

Insufficient information has been provided as to the content and use of the proposed new signage, is it discrete "business identification signage" only or does it seek to also display or promote any other branding or insignia.

The display of illuminated signage at this site at night, operating beyond the trading hours of the business premises, responds negatively to the surrounding context and Clause 65 VPP.

Considered optimistically and generously, business identification signage should only be illuminated at night during the operating or trading hours of the business, and not at any other times between sunset and sunrise.

I request that the responsible authority impose these permit conditions:

1 That the signage use be for business identification purposes only pertinent to the business within, and not the promotion nor display of any other advertisement, images, trademarks, branding or insignia that pertain to any other business or product;
2 That the signage be only illuminated between the hours of 7:00 am and 7:00 pm daily except at any times that the business premises is open for trade, where clients or customers are anticipated to ordinarily attend the premises without an appointment, outside of these hours and then only during those times;
3 That the erection of any additional illuminated signage or replacement of this sign fixture with one of an increased size be matters requiring application for a further permit;
4 That the relocation of illuminated sign from its present situation cannot be undertaken without a subsequent permit.

Internal fit outs and works for the use of the property as a culinary education school

I have no objection about the catering school changes at this site.

However like most of our neighbors’ we don’t often complain because let’s face it these days, the elected people in charge usually only pay lip service and issues important to the majority in this community mostly falls upon deaf ears.

For two weeks running, the kids and hubby have been more than a little grumpy at breakfast time than normal. I know my surrounding neighbors are also experiencing troubles with broken sleep cycles overnight. Then I saw a notice from a company called MetroCivill (VICROADS permit MOA-0046297) stating they’d be working on infrastructure upgrades along Spencer Street in West Melbourne every night for seven weeks during the hours of 9pm until 5am.

I have nothing against contractors, they are only trying to earn a living and put food on their families’ tables like the rest of us. Equally I have nothing seriously against infrastructure upgrades generally as a rule as they give everyone in Melbourne a better quality of life.

My first thought was some overzealous bureaucratic bumbler at Melbourne Council (aka the lunatic asylum) might have made such a stupid scheduling mistake. Oh, Lord Mayor Sally, I cried to myself, what have your staff done to us! But then it occurred to me the upgrade works on roads are apparently within the domain of VICROADS, a department of our STATE GOVERNMENT OF VICTORIA, (aka Beijing 2.0). Thanks very much chairman Dan for allowing one of your generals, hell bent acting like rabid Nazis rather than doing the best job for the large number of Victorians living in West Melbourne. Why your generals need to ram such poor practices down all our throats and ears, doing excessively loud works at ungodly hours all night long when there’s already sufficient quantity of construction works during the day that would blend into other daily background noise.

Then I asked myself why the bloody hell are the EPA people not putting a stop to this nocturnal noise Armageddon? Well, I quietly contemplated, then found out just like VICROADS, the EPA is also a department under the control of our wonderful (not) STATE GOVERNMENT OF VICTORIA. Oh, God, please shoot me now.

But seriously scientific studies have shown that children (and adults) who suffer from excessive road/construction noise during their sleep times are 86 percent less likely to absorb and learn skills and information from their teachers (work environment) in the classrooms (or at adults’ jobs).

Oh, Lord Mayor Sally, and Premier Dan, please make the late-night construction noise that we are expected to endure until the 11th of June 2023 overnight be switched to daylight hours. You have kids, surely you wouldn’t want yours to be placed in harm’s way as is being done in West Melbourne.

VICROADS might be worried transferring to day shift could disadvantage some people who live outside this municipality, driving in their vehicles all the way in from the outer western suburbs to come into the CBD, might cause a bit of traffic congestion. The damage you are inflicting upon all the thousands of residents who live within our municipality who are affected by this awful late-night noise will lead to a much bigger problem and long-term health issues to the West Melbournite’s who ride bikes and vote at state and council elections.

I bet you if the shoe was on the other foot, you’d all have plenty to say against the same kinds of late-night construction nose in your own backyard.

Ok, let’s imagine for one second that you actually don’t seriously care about West Melbourne resident’s noise concerns. Then imagine Victoria being shortly overtaken and run by the GREENS, with Adam Bandt (aka lazy Koala) as Premier. Endearing but ultimately ineffective. By that stage goodness knows what kind of strife we’ll all face then.

Come on Premier Dan, please make VIC Roads switch all current and future infrastructure upgrades in West Melbourne from nighttime work to normal business hours.

Do it for the sake of all Victorian children today, now and in their future.

This is a long-time residential area with long-term residents. Adding more bars to the area on top of those already there will have a significant negative impact on the safety, security, and peace of the residents living nearby. New businesses should not be allowed to disrupt the day to day lives of local residents who have lived in the area for many years. Bars should open in commercial area, not residential areas.

I strongly object to this application. It is clearly an ambit claim to avoid the Planning scheme amendment condition lapsing and enabling the illegal demolition of the Carlton Inn to set a precedent. If approved this permit will prove that planning law has no power to reign in the shonky developers. It gives the Corkman Cowboys what they wanted - windfall profits from an illegally cleared site.

This house has been empty and in a dilapidated condition for close to a decade. How is it that this is permitted by the local authorities?
The garden is overgrown, the windows are boarded up and it’s an eyesore on the street.
A new fence is welcome but the larger issue is that the house and gardens should be similarly attended to.

It’s started! Yep! I refer to my objection regarding out of hours operation of the loading dock from five years ago. I never envisaged having a loading dock for Aldi in Stanley Street would impact residents residing in Roden street. Well yes it now does before Aldi even opens!. Last night we had a large Aldi semi trailer drive down Roden Street adding to unnecessary traffic congestion and noise at an unreasonable hour, of 10pm, Thursday, 15 September, 2022. The vehicle then proceeded into Stanley street and reversed into the Aldi loading dock without Traffic Control, creating traffic and noise disruption to neighbours with children residing across the road. The noise was extremely intrusive for these residents, and will be for new residents moving in to live above the loading dock next week.

Note: there is no break in the parking bays between east/west bound lanes allowing for cross over traffic. This makes it more complicated for large trucks to safely enter and exit. The construction company Crema had a mandatory traffic OH&S management person control traffic for smaller and larger vehicles.

I have been a guest at SoHo Houses in other cities and the idea is fabulous
BUT..... not in quiet residential South Yarra. We have enough problems with the Punt Road 24 hour clearway and daily peak-hour through-traffic during the week. To then, add more traffic 24/7 from this venue is the start of South Yarra becoming a 24 hour noisy suburb. This area already has issues with noisy patrons leaving Domain Road restaurants. Particularly several drivers rev their high octane cars and dangerously use Domain Road as a speedway for fun especially late at night and on the weekend. The Police are currently monitoring this issue and I can only see more Police Patrols if the venue goes ahead.
Street parking always an issue, particularly since Punt Road became a 24/7 Clearway and Street Parking Permit owners living in Punt Road can now only park in surrounding CoM South Yarra streets. Even using ONE parking spot outside the entrance to venue drop-offs is problematic
