This was obviously the intention all along as it was built with many external doors and hot water systems. The council must have known that this was not intended to be a residence and is already not used as such. Why was the original application not designated as a group home? I am assuming to circumvent approval so why should it be approved now?

If you're applying for a Complying Development Certificate (CDC) in NSW, you can bypass local council by hiring a registered private certifier. Both council and private certifiers have the exact same legal authority and are bound by the same planning codes.
