- 1. Amendment to condition 7 - New dwellings on both lots are proposed to commence construction at the same time. Demolition of the existing structure to obtain the Statement of Compliance, followed by a separate building application process for the new dwellings, is expected to take between 6–12 months. If the existing structure is removed now, we will be left without any rental income during this period. Accordingly, we request that a condition be added to the Section 173 Agreement requiring demolition of the existing dwelling(s) prior to the commencement of construction of any of the new dwellings, rather than at an earlier stage. 2. TPZ encroachment - Allow 20% Tree Protection Zones (TPZ) within the new Australian Standard AS 4970:2025 Protection of Trees on Development Sites
