- Modification to Development Consent DA-47/2021/A Under Section 4.55 (1) of the Environmental Planning and Assessment Act 1979, to Council have made an error by retaining condition 19 [Landscaped Area] of the original DA Consent. There are no longer any trees on site as per the recent clause 4.55 modification approval. We have been asked by Council to lodge a section 4.55[1] application to amend this, and request that all fees are waived for this Application, as this was an error on Council's behalf.
